What Is Stamp Duty and Why Does It Matter?
Stamp duty is a state-levied tax on instruments (legal documents) that transfer or create an interest in property. In Delhi it is governed by the Indian Stamp Act, 1899 as amended by the Indian Stamp (Delhi Amendment) Act, 2001 and the Delhi Stamp (Prevention of Under Valuation of Instruments) Rules, 2007. The duty must be paid before or at the time of execution of the instrument; a document that is insufficiently stamped cannot be registered, cannot be produced in court as evidence, and must be impounded and sent to the Collector of Stamps for assessment and penalty. Registration separately records the deed in the public register under the Registration Act, 1908 and gives it legal enforceability against third parties.
Delhi Stamp Duty Rates 2026
The rates applicable for property transactions in Delhi in 2026 are governed by the Schedule to the Indian Stamp (Delhi Amendment) Act, 2001. Stamp duty on a conveyance (sale deed) is calculated on the higher of the circle rate or the actual consideration: Male buyer — 6%; Female buyer — 4% (a concession to encourage women’s property ownership); Joint purchase (male and female) — 5%. Circle Rates and How They Work
Circle rates (also called ready reckoner rates) are the minimum property values fixed by the Delhi government for each locality. They are the base for stamp duty calculation: you pay stamp duty on the higher of (i) the circle rate valuation of the property and (ii) the actual agreed sale consideration. Circle rate categories in Delhi run from Category A (premium localities such as Golf Links, Vasant Vihar: minimum land rate ₹7,74,000 per sq. m.) to Category H (lowest: ₹23,280 per sq. m.). In between: B ₹2,45,520, C ₹1,59,840, D ₹1,27,680, E ₹70,080, F ₹56,640, G ₹46,200. The circle rate valuation factors in land area, construction cost per sq. m. (by category and property type), age of building, and use type (residential, commercial, industrial). The Delhi Stamp (Prevention of Under Valuation of Instruments) Rules, 2007 govern the computation. How to Calculate Stamp Duty
The calculation has two steps: Step 1 — Property valuation. Compute the circle rate value of the property using the area, construction factor, age factor and locality category (per the 2007 Rules). Compare this with the actual agreed price. Take the higher of the two — this is the chargeable value. Step 2 — Apply the stamp duty rate. Multiply the chargeable value by the applicable rate (6% / 4% / 5% depending on buyer and zone). Add 1% for registration fee. If the property is above ₹25 lakh, add 1% MCD transfer duty. Example: A male buyer purchases a flat in an MCD area with an agreed price of ₹80 lakh; the circle rate valuation comes to ₹85 lakh. Chargeable value = ₹85 lakh (higher). Stamp duty = 85 × 6% = ₹5.1 lakh. Registration fee = 85 × 1% = ₹85,000. MCD duty = 85 × 1% = ₹85,000. Total = ₹6.8 lakh.
How to Pay Stamp Duty in Delhi
In Delhi, stamp duty is paid through the e-Stamp system via SHCIL (Stock Holding Corporation of India Limited, the authorized vendor). Physical stamp paper is no longer the primary mode for property transactions. The buyer pays online at shcilestamp.com, receives an e-Stamp certificate with a unique certificate number, and attaches it to the deed. Alternatively, payment can be made through any of SHCIL’s authorized collection centres across Delhi. Once stamp duty and registration fees are paid, the parties book an appointment online at igrsdelhi.gov.in and attend the Sub-Registrar’s office for execution and biometric (Aadhaar) verification. The registered deed is returned on the same day or the next working day.

Stamp Duty Concessions and Exemptions
Delhi provides certain concessions on stamp duty. The most important is the 2% concession for female buyers (4% vs 6%), which makes registering property in a woman’s name financially advantageous and is a deliberate policy to promote women’s property ownership. Gift deeds within the family (blood relations) attract a reduced rate of 3%. Relinquishment deeds between co-owners also carry lower duty than a sale. Wills are not chargeable with stamp duty at all (though optional registration at the Sub-Registrar costs a nominal fee). Lease deeds for terms up to one year attract lower duty than longer leases. However, there is no general exemption for agricultural land, affordable housing, or first-time buyers under current Delhi rates — verify any specific concession with the Sub-Registrar’s office or at revenue.delhi.gov.in.

Verify title and obtain encumbrance certificate
Through an advocate, conduct a title search going back at least 12–15 years, check the encumbrance certificate from the Sub-Registrar’s office, and verify mutation records and possession status. A buyer who skips title diligence cannot later claim protection as a bona fide purchaser.

Find the circle rate category of your locality at revenue.delhi.gov.in. Compute the circle rate valuation of the property (area × land rate + construction value × age factor).
