Senior Citizen Protection — Legal Framework

The Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (MWPSC Act) is the primary legislation protecting persons aged 60+ years. Maintenance ceiling: Section 9(2) caps maintenance at ₹10,000 per month (the 2019 Amendment Bill which proposed removing this ceiling was introduced on 11.12.2019 but lapsed and is not in force). The Supreme Court’s Urmila Dixit v. Sunil Sharan Dixit (2025 INSC 20, 02.01.2025) significantly strengthens Section 23. The Court held that this beneficial provision is to be construed liberally: a maintenance condition need not be spelled out in the gift deed itself — it can be inferred from surrounding circumstances (there, a vachan patra/promissory note plus evidence of neglect), and once the twin conditions in Sudesh Chhikara (2022) are met the Tribunal can both void the transfer and order possession restored. This makes S.23 a powerful, fast remedy against children who take a parent’s property and then neglect them — but the senior citizen must still show that care was a condition of the transfer and was not provided.

When the property was gifted, keep proof that care was a condition — the gift deed’s recital, any vachan patra, messages, medical bills, and evidence of neglect or ill-treatment (Urmila Dixit; Sudesh Chhikara). What is the maintenance amount a senior citizen can receive?

Under Section 9(2) of the MWPSC Act the maintenance ceiling is ₹10,000 per month. The Tribunal fixes the amount within this ceiling based on: the senior citizen's needs (food, medical, shelter, medicines, nursing care), the income and financial capacity of the children, and the lifestyle the senior citizen was accustomed to. Can a senior citizen get their children evicted from their own property?
